Terms and Conditions

This website and the booking service contained in this website (together, the "Booking Service") are provided by First Games Transport Limited ("FGTL").

The following terms & conditions (including, to the extent appropriate, the annexes attached hereto) form the entire understanding between FGTL and/or, where relevant, the Olympic Delivery Authority (the "ODA") and you, the customer, in relation to your purchase of any services that are available via this website (whether purchased via this website or via telephone). If you do not agree with these terms, you must not use the Booking Service.

The definitions in Annex 6 apply to these terms and conditions including its Annexes unless the context otherwise requires.

SERVICES AVAILABLE VIA THIS WEBSITE

Tickets for coach services

You are able to purchase tickets for travel on the coach services referred to in this website. Your contract for travel on any of these services will be with FGTL or such other FirstGroup company that may operate the coach service concerned, as notified to you in the Order Confirmation referred to below. The Conditions of Carriage set out in Annex 2 will apply to any coach services booked by you. The ODA will not be a party to your contract for travel on any coach service and the ODA will have no liability to you in respect of such travel.

Tickets for parking at Park & Ride Sites

You are able to purchase tickets for parking at the Park & Ride Sites referred to in this website. Your contract for parking at any Park & Ride Site will be with the ODA. That contract will include the terms and conditions in Annex 3 as well as any provisions in this initial part of these terms and conditions which are expressly stated to apply to the ODA. FGTL will not be a party to that contract.

Park & Ride Shuttle services will be available between each Park & Ride Site and the Games Venue(s) that such site serves. There is no additional charge to use the Park & Ride Shuttle services and you do not need to make any booking in addition to the ticket for parking at the Park & Ride Site in order to use the Park & Ride Shuttle services. However, please note that if you choose to travel on a Park & Ride Shuttle, your contract for travel on that Park & Ride Shuttle will be with FGTL or such other FirstGroup company that may operate the Park & Ride Shuttle concerned and the Conditions of Carriage set out in Annex 2 will apply to that contract. The ODA will not be a party to that contract and the ODA will have no liability to you in respect of such travel.

Tickets for Blue Badge parking

Blue Badge holders are able to purchase tickets for parking at the Blue Badge Sites referred to in this website. Your contract for parking at any Blue Badge Sites will be with the ODA.

If you are a Blue Badge holder and you purchase parking at a Park & Ride Site, your contract with the ODA will include the terms and conditions in Annex 3 (Conditions of use of Park & Ride Sites) as well as any provisions in this initial part of these terms and conditions which are expressly stated to apply to the ODA. FGTL will not be a party to that contract.

If you purchase parking at any other Blue Badge Site, your contract with the ODA will include the terms and conditions in Annex 4 as well as any provisions in this initial part of these terms and conditions which are expressly stated to apply to the ODA. FGTL will not be a party to that contract.

Private Charter parking and access to Transit Malls

The operators of Private Charter services are able to purchase tickets for

  1. parking at Barking Bus Depot and
  2. access to the Transit Malls.
Your contract for such access and/or parking will be with the ODA. That contract will include the terms and conditions in Annex 5 as well as any provisions in this initial part of these terms and conditions which are expressly stated to apply to the ODA. FGTL will not be a party to that contract.

USE OF THIS WEBSITE

The additional terms & conditions set out in Annex 1 apply to the use of this website and set out the privacy policy.

USE OF THE BOOKING SERVICE

You must be over 16 years of age to purchase the services on this website. By purchasing any of the services available on this website (whether purchased via this website or via telephone), you confirm that:

  1. you have authority to use the payment method or billing account details you provide for the purpose of settling any payments due for any purchase made, or that you owe to FGTL;
  2. you have authority to use this site and/or purchase the services advertised hereon in accordance with all relevant terms & conditions set out herein; and
  3. all information supplied by you is accurate and true.

All customers using the services on this website to travel to Olympic and Paralympic venues are advised to review the terms & conditions for entry to the venues, available at www.London2012.com. The terms & conditions presented herein relate only to those regulating the Booking Service, coach services, use of Park & Ride Shuttles, parking and access to Transit Malls that are available via this website.

If FGTL accepts your offer to purchase services you will be sent an Order Confirmation setting out details of your order and your rights of cancellation. The contract between you and FGTL and/or the ODA (as appropriate) will be formed at the time the Order Confirmation is sent. The contract will be concluded in English.

DISCLAIMER

The information published on www.firstgroupgamestravel.com is provided as a convenience to customers and should be used for information purposes only and is subject to change without notice. While FGTL use all reasonable efforts to ensure that the information contained on this website is current, accurate and complete at the date of publication, no representations or warranties are made (express or implied) as to the reliability, accuracy or completeness of such information. Therefore, neither FGTL nor the ODA can be held liable for any loss arising directly or indirectly from the use of, or any action taken in reliance on, any information appearing on this website. In addition, no warranty is given as to the freedom of this website from errors, defects, viruses or other malicious programs or macros.

RESERVATIONS

Online purchases are available only at www.firstgroupgamestravel.com. Telephone purchases are available only via 0844 921 2012. Calls made to this number may be recorded. The maximum call charge is 5p per minute from a BT landline, calls from mobiles and other networks may vary. Call charge information is given purely to assist call centre customers. FGTL accepts no responsibility or liability for changes in prevailing telephone call rates.

Tickets for coach services are sold on a "per person" basis, except where a group offer (including family tickets) exists. FGTL will allocate all coach reservations to specific vehicles. FGTL offer no guarantee that all party members contained within a booking will be allocated to a single vehicle in instances where multiple departures are available.

Tickets for parking at Park & Ride Sites are sold on a "per parking space" basis. Subsequent travel on a Park & Ride Shuttle to a Games Venue will be available for up to seven (7) persons where the booking exists for a car or sixteen (16) persons where the booking is made for a minibus.

Tickets for parking at Blue Badge Sites and tickets for parking of Private Charter vehicles are sold on a "per parking space" basis. Private Charter reservations at Transit Malls are sold on a "time slot" basis.

If you have purchased a ticket for parking at a Park & Ride Site, a Blue Badge Site or (in respect of Private Charters) a reservation at a Transit Mall or a ticket for parking at Barking Bus Depot, then you will receive a printed travel pack, sent to the address provided by you during the booking process.

If you have purchased a coach ticket then upon completion of your booking FGTL will issue you with a confirmation email including your booking code. An e-ticket will then be issued eight (8) weeks prior to the date of travel. If you do not have access to email, you should complete your booking through the call centre. Coach customers making purchases through the call centre may request a printed travel pack be posted to their home address (as provided during the booking call) as an alternative to the email confirmation.

It is your responsibility to check that the confirmation or ticket issued to you is accurate and matches your request. FGTL is only responsible for issuing the confirmation or ticket in line with your request made during the booking process.

All e-tickets, standard tickets and all other relevant travel documents will be emailed or posted to the address registered during the booking process eight (8) weeks prior to the date of travel.

If you have provided FGTL with a mobile telephone number and indicated your agreement to FGTL and/or the ODA contacting you, FGTL and/or the ODA may send you a text message with details of any service disruption information.

Coach bookings are only available as a day return and are only valid for the date and schedule specified within the booking. All bookings for parking at Park & Ride Sites, Blue Badge Sites and bookings in respect of Private Charters (access to Transit Malls and/or parking at Barking Bus Depot) are only valid for the date and schedule specified within the booking.

It is your responsibility to ensure that the date and schedule chosen are suitable for your needs (including, without limitation, any timing requirements related to tickets for Olympic and Paralympic events).

Customers will be notified by email that tickets and other travel documents have been posted within two days of dispatch. If tickets have not been received within two weeks of the dispatch date then customers should contact the call centre on 0844 921 2012.

If FGTL or the ODA have reason to suspect fraudulent use of this website or of a ticket or reservation confirmation, transfer to a different person, or other abuse, FGTL and the ODA (as appropriate to the service concerned) reserve the right to refuse you travel on the coach service(s), parking and/or access to the Transit Malls (as appropriate). No refund will be made in relation to any fraudulent use.

BOARDING OF COACH SERVICES

In order to board your booked departure, you will need to provide a valid booking confirmation code. FGTL reserves the right to refuse boarding to any individual unable to present a valid booking code.

Customers are required to be at their departure point at least five (5) minutes prior to the scheduled departure time. This allows customers to board in a timely manner avoiding any delays that may impact on the departure of the service. All services will depart at their scheduled departure time. Departures will not be delayed due to the over-running of an event or the late arrival of a customer, as such delays will have a detrimental effect on on-time customers as well as possible knock-on operational issues on subsequent services.

CANCELLATION

'Cooling off' period

Subject to the terms of the following paragraph, you may cancel an order for the supply of services at any point from the day on which the contract is concluded (in the case of orders made via the website, the day on which an Order Confirmation email is sent; and in the case of orders made through the call centre, the day on which the FGTL representative confirms that the order has been received) for a period of seven (7) working days from the day after the contract is concluded.

Notice of cancellation must be from the person specified on the Order Confirmation email and sent to FTGL. Notice received within the time period via email or otherwise in writing will be valid, but notice via telephone will not be valid unless written confirmation is received by FGTL within the time period.

Unless otherwise agreed, you will not be able to cancel any contract for the supply of services within seven (7) working days of the date of travel specified by you during the booking process, even where this falls within the 'cooling off' period set out above.

The booking fee is non-refundable.

Cancellation outside the 'cooling off' period

After expiration of the cooling off period, you will be able to cancel at any time up to and including 29th February 2012. Cancellation during this period will entitle you to a full refund of any payments received by FGTL, save that the booking fee paid during the original transaction will not be refunded. Such a refund will be subject to a £5.00 administration charge. Cancellation and consequent refunds after this date will only be permitted during the 'cooling off' period set out above.

REFUNDS FOR DELAYS TO COACH SERVICES

In the event that, as a direct consequence of operational issues within the control of FGTL or any other FirstGroup company, the coach service arrives at its scheduled destination in excess of one (1) hour after the scheduled arrival time, then the customer is entitled to a full refund of the ticket price and any applicable booking fee.

However, if the delay is due to events outside the control of FGTL or any other FirstGroup company (a force majeure event, including, without limitation, extreme traffic congestion, road works, road closures, major events or adverse weather conditions), neither FGTL nor any other FirstGroup company will be liable to offer any refund to customers.

In any event the value of any refund to a customer may not exceed the price paid by that customer for the service on which they are booked to travel and any applicable booking fee. FGTL shall have no further liability to you other than as set out in this paragraph.

If a service is cancelled or materially changed prior to the date of travel then FGTL reserves the right to offer alternative transport arrangements or provide a full refund.

DELAYS TO PARK & RIDE SHUTTLE SERVICES

Since there is no charge for the use of the Park & Ride Shuttle services, FGTL will not be obliged to provide any refund or other compensation to customers in respect of any delay to a Park & Ride Shuttle service.

REFUNDS IN RESPECT OF PARKING

Where the ODA is unable to provide space for you to park your vehicle at the Park & Ride Site or Blue Badge Site specified in your booking, the ODA will use its reasonable endeavours to identify space for you to park you vehicle at another Park & Ride Site or Blue Badge Site (as appropriate) or other location serving the same Games Venue. In such circumstances:

  1. Where you have purchased parking at a Park & Ride Site and the ODA identifies a location for you to park your vehicle which is not a Park & Ride Site (as specified on this website), the ODA will nevertheless use its reasonable endeavours to provide Park & Ride Shuttle services between that location and the relevant Games Venue.
  2. Where you have purchased parking at a Blue Badge Site and the ODA identifies a location for you to park your vehicle which is not a Blue Badge Site (as specified on this website), the ODA will nevertheless use its reasonable endeavours to ensure that the relevant location takes account of any mobility requirements that you have notified to FGTL at the time of booking.

In the event that, as a direct consequence of operational issues within the control of the ODA, the ODA is unable to provide space for you to park your vehicle at the Park & Ride Site or Blue Badge Site specified in your booking or an alternative location, you will be entitled to a full refund of the ticket price in respect of the parking that you have booked and any applicable booking fee.

However, if the ODA is unable to provide space for you to park your vehicle at the Park & Ride Site or Blue Badge Site specified in your booking or an alternative location as a result of events outside the control of the ODA (a force majeure event, including, without limitation, act of God, war damage, enemy action, terrorism or suspected terrorism, riot, civil commotion or rebellion, adverse weather conditions, fire or action necessary to comply with any governmental regulation), neither FGTL nor the ODA will be liable to offer you any refund.

In any event the value of any refund to you may not exceed the price you paid for the Park & Ride Site or Blue Badge Site specified in your booking and any applicable booking fee. The ODA and FGTL shall have no further liability to you other than as set out in this paragraph.

Please note that if you are entitled to any refund under this paragraph, all claims and correspondence in respect of such refund should be addressed to FGTL. FGTL will be responsible for the payment of any refund that is due.

REFUNDS IN RESPECT OF PRIVATE CHARTER RESERVATIONS

Where the ODA is unable to provide access to the Transit Mall specified in your booking, the ODA will use its reasonable endeavours to provide access to an alternative Transit Mall, or other location for the loading / off-loading of passengers, serving the same Games Venue.

Where the ODA is unable to provide space for you to park your vehicle at Barking Bus Depot in accordance with your booking, the ODA will use its reasonable endeavours to identify space for you to park you vehicle at another location within a reasonable distance of the Olympic Park.

In the event that, as a direct consequence of operational issues within the control of the ODA, the ODA is unable to provide:

  1. access to the Transit Mall specified in your booking or an alternative Transit Mall or another location for the loading / off-loading of passengers, in either case serving the same Games Venue, you will be entitled to a full refund of the ticket price in respect of such access to the Transit Mall that you have booked and any applicable booking fee.
  2. space for you to park your vehicle at Barking Bus Depot or an alternative location, you will be entitled to a full refund of the ticket price in respect of the parking that you have booked and any applicable booking fee.

However, if the ODA is unable to provide access to the Transit Mall or an alternative for the same Games Venue or space for you to park your vehicle at Barking Bus Depot or an alternative location as a result of events outside the control of the ODA (a force majeure event, including, without limitation, act of God, war damage, enemy action, terrorism or suspected terrorism, riot, civil commotion or rebellion, adverse weather conditions, fire or action necessary to comply with any governmental regulation), neither FGTL nor the ODA will be liable to offer you any refund.

In any event the value of any refund to you may not exceed the price you paid for access to the Transit Mall or parking at Barking Bus Depot (as appropriate) and any applicable booking fee. The ODA and FGTL shall have no further liability to you other than as set out in this paragraph.

Please note that if you are entitled to any refund under this paragraph, all claims and correspondence in respect of such refund should be addressed to FGTL. FGTL will be responsible for the payment of any refund that is due.

ALTERATION OR CANCELLATION OF GAMES EVENTS

Neither FGTL nor the ODA accept any responsibility for any loss, damage or inconvenience arising as a result of any alteration (both to time or location), cancellation, delay or suspension of any Games event. It is your responsibility to check that the event(s) which you wish to attend are taking place. In the event that the event is altered, cancelled, delayed or suspended, neither FGTL nor the ODA will be obliged to offer any refund, compensation or ticket exchanges.

AMENDMENTS TO BOOKINGS

All requests to reschedule or amend a booking for any of the services listed on the website (including bookings for coach services, parking at Park & Ride Sites and Blue Badge Sites, and Private Charter reservations) must be made to FGTL via the call centre on 0844 921 2012.

If you identify that you have made an error in your booking and notify the booking agent within twenty four (24) hours of the sale then the error may be corrected without incurring a further booking fee. Errors notified beyond this timescale may incur a further booking fee, at the complete discretion of FGTL.

Customers may request any reasonable changes of an administrative nature to booking details at any time prior to the date of travel (including, but not limited to, change of home address for dispatch of tickets or vehicle registration information for parking at Park & Ride Sites or Blue Badge Sites or Private Charter reservations, but excluding date/time of travel and number/identity of customers). The amendment will not be liable to any further booking or administration fees, unless the amendment requires the issue of a new ticket (for example, the cancellation of a child ticket and the issue of an adult ticket in the same name). Confirmation of the change will be issued to you.

LOST, STOLEN, FORGOTTEN AND DAMAGED TICKETS

It is the responsibility of the customer to retain all necessary travel / parking details and be able to present these for inspection at the time of travel, parking or use of the Transit Malls (as appropriate). FGTL will not be liable to compensate you for lost, stolen, forgotten or damaged tickets or other travel details.

Customers should notify the FGTL call centre on 0844 921 2012 as soon as they are aware of the loss of any travel, parking or Private Charter reservation details. Where the travel pack for parking at a Park & Ride Site or Blue Badge Site or Private Charter reservation has been lost a new pack will be issued. Where the ticket and/or e-ticket for coach services has been lost, a new ticket will be issued.

FGTL reserves the right to refuse boarding to any coach or Park & Ride Shuttle service to any individual unable to present valid travel details. The ODA reserves the right to refuse access to Park & Ride Sites, Blue Badge Site, Transit Malls or Private Charter parking facilities if any individual is unable to present valid travel details.

FARES AND TICKET PRICES

Bookings for each of the services referred to in the website are offered based on a variety of ticket prices. All prices are shown in £ Sterling. Fares and ticket prices are subject to change without notice.

For travel on coach services, a limited amount of seats may be available for any particular price, and FGTL may limit such fares for any reason and at any time.

A booking is confirmed only at sale. If the price has changed before sale the customer must reselect the fare or ticket price available at that time. Any increase or decrease in fares or ticket price following the sale will not be adjusted to the customer.

A reasonable booking fee may be applied at the point of sale, regardless of the method used to make the booking. This will be clearly advised to the customer prior to confirming their booking.

Bookings made through the call centre will be sold at the same price as those booked via this website, including any applicable booking fee.

Children under the age of two (2) years old may travel for free on any coach service but are not guaranteed a seat unless a seat has been purchased for them and a reservation number is provided. Children travelling for free may not use seats if fare paying customers want them.

Any customer travelling on a ticket purchased at a concessionary rate must present the relevant and valid concessionary fare pass upon inspection of the ticket, or be subject to the full adult fare for travel on that service.

FirstGroup and affiliated company staff passes are not valid for travel on the services booked through this website.

PROMOTIONS & DISCOUNTS

FGTL reserves the right to introduce or withdraw any promotion or discount at any time, including before any published end date.

FGTL reserves the right to restrict the number of times a promotional discount may be obtained by an individual as part of any specific promotion.

Promotions may be restricted to certain departure or destination locations, and to certain departure times.

APPLICABLE LAW

Any use of this website, and any agreements made pursuant to these terms & conditions (including any contracts formed with the ODA), shall at all times be governed by English law and, in the event of any dispute, the relevant parties shall irrevocably submit to the exclusive jurisdiction of the English Courts.

CCTV

The vehicles and other property (including, without limitation, the Park & Ride Sites, the Transit Malls and the Blue Badge Sites) used to provide the services that may be booked through this website may be fitted with CCTV to provide added security, monitor the conduct of customers and to assist FGTS and the ODA in the process of deterring smoking, vandalism, fraud, theft, anti-social behaviour and attacks on employees and other individuals.

CCTV footage filmed on the vehicles or at any of the sites used to provide the services booked through this website may be passed to the police to be used as evidence in prosecuting criminal activity or in assisting the identification of individuals. This equipment and its operation comply with the Data Protection Act 1998 (including the CCTV Code of Practice) and any subsequent amendments.

FGTS and the ODA will use all means to secure prosecution of anyone who causes injury to its employees or damage to its vehicles or property.

GENERAL NOTICE

All references to the terms & conditions includes a reference to the Annexes to the extent appropriate.

Failure or delay by FGTL or the ODA to enforce an obligation or exercise a right under these terms & conditions does not constitute a waiver of that obligation or right.

If any provision or term of these terms & conditions shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be divisible from the other terms & conditions and shall be deemed to be deleted from them, but (except to that extent in the case of that provision or term) it and all other provisions of these terms & conditions shall continue in full force and effect and their validity, legality and enforceability shall not be thereby affected or impaired.

FGTL (with approval from the ODA to the extent required) may alter these terms & conditions from time to time and post the new version on its website, following which all use of the website will be governed by that version. It is your responsibility to check the terms & conditions on the website regularly and prior to making a reservation.

Unless specifically stated otherwise herein or required by law, neither FGTL nor the ODA shall be liable for any consequential, compensatory, indirect, incidental or punitive damages arising out of or in connection with the performance of its obligations under these terms & conditions.

Where these terms & conditions exclude or restrict the liability of FGTL or the ODA in respect of any loss, damage, expense or injury, neither FGTL nor the ODA intend to exclude or restrict liability for death or personal injury resulting from the negligence of the ODA or FGTL (or that of their directors, employees or agents), for fraud or fraudulent misrepresentation, or for any matter, liability for which they cannot legally limit or exclude or attempt to limit or attempt to exclude.

FGTL and, to the extent appropriate, the ODA, has the right to cancel reservations (whether or not confirmed) of any customer whenever such action is necessary to comply with any governmental regulation, upon any governmental request for emergency transportation in connection with the national defence, or whenever such action is necessary or advisable by reason of events outside the control of FGTL or the ODA, as appropriate (a force majeure event, including, without limitation, extreme traffic congestion, road works, road closures, major events or adverse weather conditions).

  4. in respect of tickets for parking at Blue Badge Sites, the operator of the relevant Blue Badge Site; and
  5. organisations directly involved in the update and/or maintenance of this website, including our website designers and technical consultants.
In each case, such information will be used by such organisations only to perform their functions and/or to provide the service you have requested and for no other purpose.

In addition, all payment transactions are handled by WorldPay Limited, a secure payment processing provider. Your credit card and related personal details are collected by WorldPay Limited in order to process your payment. ANNEX 2

CONDITIONS OF CARRIAGE — COACH SERVICES AND PARK & RIDE SHUTTLE SERVICES

By purchasing coach services and/or travelling on any Park & Ride Shuttle service, you agree to be bound by the following additional terms & conditions relating to travel on our coach services and/or any Park & Ride Shuttle service. In this Annex 2, "we", "us" or "our" refers to FGTL and such other FirstGroup company that may operate the coach service or Park & Ride Shuttle service concerned.

Where FGTL subcontracts provision of any coach service or Park & Ride Shuttle service to a company other than a FirstGroup company, although your contract for travel on the relevant coach service or Park & Ride Shuttle service will be with FGTL, the subcontractor may exercise FGTL's rights and perform FGTL's obligations under that contract.

General

All children under the age of 14 years must be accompanied by an adult (16 years of age or over) when travelling on our services.

Smoking is prohibited aboard the vehicle in accordance with UK law.

We reserve full control of, and discretion as to, the seating of customers and the right to change such seating at any time during the trip.

It is a condition of travelling that all persons aged 14 and above wear a seatbelt on our services where UK law requires them to do so.

Our services are unable to carry animals, with the exception of guide and other assistance dogs. Guide and other assistance dogs will be permitted to travel with the customer at no additional charge.

There may be occasions when services take longer than expected and/or services may need to be diverted or cancelled due to factors beyond our control, including without limitation extreme traffic congestion, road works, road closures, major events or adverse weather conditions. To the extent possible, we will endeavour to advise customers of any disruption to services. However, we reserve the right, in certain circumstances, to alter, withdraw or suspend services, fares and conditions without notice. In any event, we accept no responsibility for any loss, damage or inconvenience arising as a result of any such alteration, withdrawal or suspension.

We reserve the right, when operating conditions require, to transfer customers from one vehicle to another en route.

Neither the ODA nor FGTL nor any other FirstGroup company will be liable for any loss, damage, or inconvenience arising from the communication of information in good faith by any of their employees (or their agents and subcontractors).

We shall have the right to refuse to transport or shall have the right to remove any customer for the safety of such customer or other customers or drivers, including, but not limited to:

  1. persons whose conduct is disorderly, offensive, abusive, or violent, or is such or likely to be such as to make him or her objectionable to other customers or prospective customer;
  2. persons who fail to comply with or interfere with the duties of the driver;
  3. persons who wear or have on or about their person concealed or unconcealed deadly or dangerous weapons;
  4. persons who are or appear to be under the influence of intoxicating liquor or drugs.
Such persons may be removed from the vehicle at such place along the route as the driver may select. We shall not provide any compensation for customers so removed.

Customers, while travelling on, boarding or alighting from a vehicle, must not:

  1. behave in a manner which may reasonably be expected to cause any persons to be alarmed, upset, offended or annoyed, or which may reasonably be expected to cause a nuisance or inconvenience to any customer, driver or other third party (including, without limitation, the use of obscene or offensive language or behaving in a manner that is abusive or threatening);
  2. behave in a manner which may reasonably be expected to result in loss, injury or damage to property or persons;
  3. cause the driver to be distracted while driving, except in an emergency or for reasons of safety;
  4. play radios, musical instruments, mobile telephones, MP3s or other equipment on vehicles with the exception of personal listening devices with an earpiece which must not be played at a volume that is likely to cause nuisance.
  5. E. use roller skates, roller blades, scooters or skateboards;
  6. lean out of the vehicle;
  7. throw or trail any article from the vehicle;
  8. sell, or offer for sale, any item;
  9. distribute/display printed or similar matter of any description or distribute any article for the purpose of advertising;
  10. use any door for a purpose other than as indicated by a notice, unless directed to by the driver;
  11. remain on the vehicle when directed to leave by the driver, or other official; or
  12. deliberately interfere with any equipment fitted to the vehicle.

Every customer travelling on our vehicles is carried subject to the Public Service Vehicles (Conduct of Drivers, Inspectors, Conductors and Passengers) Regulations 1990, and these terms & conditions. Persons failing to comply with the statutory regulations and these terms & conditions may be refused travel or may be asked to leave a vehicle, at the sole discretion of FGTL (or any of its, or its group companies', employees).

Baggage

We assume no liability of any kind for baggage.

We do not allow the transport of any material that would be classified as a hazardous material, or which may inconvenience, or present a danger or discomfort to, other customers or block any gangway or exit (including, without limitation, acids, ammunition, animals (other than guide, or other assistance, dogs), combustible liquids, compressed gases, corpses, cremated remains, explosives, weapons, firearms of all types, fireworks, flammable liquids, furniture, hazardous materials, noxious foodstuffs, poisons, radioactive materials, etc). This list is not exhaustive and the carriage of items is at the sole discretion of the driver over which we will accept no liability.

All baggage is carried at the customer's risk. We will not accept any liability for any loss or damage. Customers will indemnify us against any liability we incur to third parties for any injury, damage, or loss caused.

You are responsible for placing your bag into the baggage bin and retrieving it at your destination. However, if you need assistance, ask and the driver will help you.

Coach baggage restrictions

Customers are permitted to bring with them only a maximum of two (2) carry-on bags, such as a purse or small backpack. A carry-on bag(s) should be small enough to fit into the overhead bins where these are available — where overhead bins are not available, it should fit on the customer's lap without obstructing gangways and access to emergency exits.

No luggage carrying facility will be available within the hold of the coach as this facility will be required for wheelchairs, mobility scooters, prams, pushchairs and bikes, and consequently customers are advised that no suitcases or similar sized luggage will be allowed on to any coach services.

Park & Ride Shuttle baggage restrictions

Customers are permitted to bring with them only a maximum of two (2) carry-on bags, such as a purse or small backpack. A carry-on bag(s) should be small enough to fit into the overhead bins where these are available — where overhead bins are not available, it should fit on the customer's lap without obstructing gangways and access to emergency exits.

Carriage of Wheelchairs, Mobility Scooters, Pushchairs etc

General

All wheelchair users are advised to notify us during the booking process of the requirement to board with a wheelchair or mobility scooter.

Coach travel

  1. Wheelchairs

    Wheelchairs should be no wider than 750mm and no longer than 1300mm in order to be carried unfolded on accessible coaches. Where a mobility scooter is to be loaded on to a coach the customer should be aware that our staff are not trained in the assembly/disassembly or stowing of mobility scooters. Where a requirement exists to assemble/disassemble and load/unload a mobility scooter the customer will need to travel with a companion capable of performing these tasks.

    Drivers are obliged to provide reasonable assistance to all customers on the basis of a helping hand or hands, only at the request of the customer, unless there is a risk to the health and safety of any customer, the driver or to a member of the public.

    In the event that the vehicle is prevented from positioning sufficiently close to the kerb to allow a seated wheelchair user to board or alight safely the driver will endeavour to identify a safe place to pull in as close to the bus stop as possible.

  2. Pushchairs

    We can only carry folded pushchairs or prams within the luggage compartment.

  3. Bicycles

    We can accommodate up to four (4) pedal bicycles within the luggage hold on all coach services. These must be pre-booked. Spaces for bicycles will be provided on a "first come first served" basis. All bicycles are carried on coaches at the customer's risk and we accept no liability for any loss or damage. Customers will indemnify us against any liability that we may incur to third parties for any injury, damage, or loss caused.

Park & Ride Shuttle services

  1. General

    Provided they meet the size and weight limits set out in the following paragraph, wheelchairs, mobility scooters, small prams and unfolded pushchairs may be carried on Park & Ride Shuttle services.

    Wheelchairs, mobility scooters, small prams and unfolded pushchairs must be no wider than 750mm and no longer than 1300mm to travel in the wheelchair area, and they must not exceed (combined with the weight of the user) the weight limit shown on the ramp or beside the doorway. It is the customer's responsibility to ensure that their wheelchair, mobility scooter, pram or pushchair satisfies these limits.

    It is the customer's responsibility to ensure that their wheelchair, mobility scooter, pram or pushchair is safely positioned within the designated area, and to ensure that it does not obstruct or block any exit or gangway.

    If a Park & Ride Shuttle vehicle is full with seated customers, and no wheelchairs or pushchairs are being carried, the wheelchair/pushchair space may be used to accommodate standing customers.

    We reserve the right to substitute without notice a non low-floor vehicle when no low-floor vehicle is available.

  2. Wheelchairs

    We can accommodate one (1) wheelchair or mobility scooter meeting the size requirements on each vehicle. If a wheelchair user is already travelling, it is not possible to allow a second wheelchair user to board.

    Provided that the vehicle is not so crowded that there is no room to travel safely (to be decided at the driver's discretion) and/or the maximum seating or standing capacity is not exceeded, drivers will allow wheelchair or mobility scooter users to board the vehicle if there is an unoccupied wheelchair space. A wheelchair user will only be refused entry when it is absolutely necessary, but no-one already travelling will be asked to alight from the vehicle in order to accommodate a wheelchair user.

    Customers are required to offer reasonable cooperation in allowing proper use of the designated wheelchair area by vacating the space if it is required by a customer in a wheelchair or mobility scooter. If a customer with a pram or an unfolded pushchair is already occupying the designated wheelchair area, s/he will be asked to relocate the pram or pushchair to another part of the vehicle or (in the case of unfolded pushchairs) to fold and store them in the luggage space, provided that it is safe and reasonable to do so.

    Drivers are obliged to provide reasonable assistance to all customers on the basis of a helping hand or hands, only at the request of the customer, unless there is a risk to the health and safety of any customer, the driver or to a member of the public.

    In the event that the vehicle is prevented from positioning sufficiently close to the kerb to allow a seated wheelchair user to board or alight safely the driver will endeavour to identify a safe place to pull in as close to the bus stop as possible.

  3. Pushchairs

    We can accommodate up to two (2) small prams or normal-sized unfolded pushchairs meeting the size requirements on each vehicle, provided that the space is not required for a wheelchair user.

    Pushchairs may only be left unfolded in an upright position when carrying a child. Empty pushchairs or pushchairs carrying luggage must be folded and placed in the luggage rack.

  4. Bicycles

    No bicycles will be permitted for carriage on any Park & Ride Shuttle services.

Security

The driver must be advised immediately if any suspicious article or package is seen on or near a vehicle.


ANNEX 3

CONDITIONS OF USE OF PARK & RIDE SITES

By purchasing parking at a Park & Ride Site, you agree to be bound by the following additional terms & conditions in respect of parking your vehicle at, and the associated use of, the Park & Ride Site. If you choose to travel on a Park & Ride Shuttle service to or from the Park & Ride Site, please note that the terms & conditions in Annex 2 (Conditions of Carriage — coach services and Park & Ride Shuttle services) apply to your travel on any such Park & Ride Shuttle service.

In this Annex 3, "we" "us" and "our" refers to the ODA, provided that the ODA may delegate its rights and obligations in this Annex 3 to MML or any other contractor that the ODA may appoint to manage any Park & Ride Site.

General

By purchasing parking at a Park & Ride Site, you agree that you are entering into a contract with us on the basis of these terms & conditions not only for yourself, but also that you are entering into this contract on behalf of any passengers in your vehicle and the legal owner of the vehicle. This means that we may enforce the terms of this contract against you or any passenger or the legal owner of the vehicle. Equally, you, any passenger and the legal owner of the vehicle can enforce the terms of the contract against us.

Smoking is prohibited within the bus loading areas at Park & Ride Sites and Games Venues.

We reserve the right, when operating conditions require, to transfer customers' bookings to an alternative Park & Ride Site serving the same Games Venue.

We shall have the right to remove any customer from a Park & Ride Site for the safety of such customer or other customers or site staff, including, but not limited to:

  1. persons whose conduct is disorderly, offensive, abusive, or violent, or is such or likely to be such as to make him or her objectionable to other customers or prospective customer;
  2. persons who fail to comply with the instructions of site staff or interfere with their duties;
  3. persons who wear or have on or about their person concealed or unconcealed deadly or dangerous weapons; and
  4. persons who are or appear to be under the influence of intoxicating liquor or drugs.
We shall not provide any compensation for customers so removed or whose vehicles are refused admission.

Customers, while using a Park & Ride Site, must not:

  1. behave in a manner which may reasonably be expected to cause any persons to be alarmed, upset, offended or annoyed, or which may reasonably be expected to cause a nuisance or inconvenience to any customer, site staff or other third party (including, without limitation, the use of obscene or offensive language or behaving in a manner that is abusive or threatening);
  2. behave in a manner which may reasonably be expected to result in loss, injury or damage to property or persons;
  3. play radios, musical instruments, mobile telephones, MP3s or other audio equipment with the exception of personal listening devices with an earpiece which must not be played at a volume that is likely to cause nuisance;
  4. use roller skates, roller blades, scooters or skateboards;
  5. sell, or offer for sale, any item;
  6. distribute/display printed or similar matter of any description or distribute any article for the purpose of advertising;
  7. deliberately interfere with any equipment on site.

We will not be liable for any loss, damage, or inconvenience arising from the communication of information in good faith by any of our employees (or their agents and subcontractors).

Arrival and Parking

Customers are requested to arrive at Park & Ride Sites within the time slot specified when making their booking. Early arrivals will be permitted access to the Park & Ride Site but may be required to wait for a Park & Ride Shuttle departure within their booked time slot. Late arrivals will be permitted access to the Park & Ride Site and Park & Ride Shuttle travel will be provided subject to availability. Customers who have arrived within their booked time slot may be given priority over late arrivals.

Customers are required to display the vehicle access permit included in their travel pack (where supplied) in the windscreen of their vehicle prior to arrival at a Park & Ride Site. We reserve the right to refuse entry to a Park & Ride Site to any individual unable to present a valid vehicle access permit.

We also reserve the right to refuse the admission of any vehicle to a Park & Ride Site for any reason whatsoever. Without limitation:

  • where the website indicates that certain types of vehicle are not permitted at a particular Park & Ride Site, vehicles of that type will not be permitted access to that site; and
  • you must not tow any vehicle, caravan or trailer into a Park & Ride Site.

Customers are required to park their vehicle as directed by site staff and in compliance with all signs in the relevant Park & Ride Site. In particular:

  1. where the Park & Ride Site is marked with parking bays, you must park within a marked bay;
  2. you must not park within a bay marked for a specific purpose (e.g. a space for the disabled) unless you are entitled to do so.

Where you park your vehicle in breach of the above requirement (or otherwise as may be reasonably required for the safety of persons or property), we may move your vehicle within the Park & Ride Site, by driving or otherwise, using whatever method we consider appropriate (even if damage is caused to your vehicle as a result) to such extent as is reasonably necessary for the purposes of the safety of persons or property or to avoid obstruction.

Park & Ride Site Security

Customers are not permitted to bring any material onto a Park & Ride Site that would be classified as a hazardous material, or which may inconvenience, or present a danger or discomfort to, other customers. Customers are also not permitted to bring any animal (other than guide, or other assistance, dogs) onto a Park & Ride Site.

Park & Ride Site staff must be advised immediately if any suspicious article or package is seen on site.

If you, your vehicle or any of the passengers in your vehicle damage any equipment at the Park & Ride Site then, except where the damage is the result of our negligence, we will have the right to recover from you the repair cost in respect of that damage plus associated administration costs.

No work on or cleaning of vehicles is permitted at any Park & Ride Site. If your vehicle breaks down you must contact the Park & Ride Site staff to ensure that the repair or removal of your vehicle is organised without causing disruption, damage or danger to any other person or property in the Park & Ride Site.

If you or any of the passengers in your vehicle damage another vehicle at the Park & Ride Site you should report the matter to Park & Ride Site staff giving the registration numbers of both vehicles. You must also notify the owner of the other vehicle by leaving a note on the windscreen of their vehicle providing your vehicle and contact details and any other details that are relevant to the incident.

Security of your vehicle and possessions

Before you leave your vehicle you should ensure that it is securely locked, all of the windows are securely closed and if your vehicle is fitted with a vehicle alarm, steering lock, or similar device, that it is engaged.

Wherever possible, you should not leave possessions in your vehicle. If you do leave possessions in your vehicle, you do so at your own risk.

No overnight parking

Overnight parking is not permitted at Park & Ride Sites. Any vehicle remaining on site for more than two hours after the arrival of the last Park & Ride Shuttle service will be treated as an abandoned vehicle and may be removed from the site where necessary for operational or security reasons.

If you have provided us with a mobile telephone number and indicated your agreement to our contacting you, site staff will endeavour to contact you before proceeding to remove your vehicle from the site.

At our discretion we may permit vehicles to be left on site overnight in the event of an emergency and where contact has been made with the customer.

Abandoned vehicles removed from Park & Ride Sites will be stored in a secure location and the customer shall be responsible for all storage charges.

We reserve the right to dispose of any abandoned vehicles and will be entitled to treat any vehicle not reclaimed within 28 days as abandoned. Before disposing of any abandoned vehicle, we will make reasonable enquiries with the appropriate Police authority.

Where we intend to dispose of an abandoned vehicle, the relevant vehicle will be sold by auction whenever practicable. The proceeds of sale will be used towards satisfaction of all sums owing to us together with the expenses of sale and reasonable storage charges for the period during which the vehicle is in our possession. If there is any balance remaining from the sale proceeds after satisfaction of these sums, we will hold that balance on behalf of the registered owner of the vehicle and will pay that balance to the registered owner on proof of entitlement.

Wheelchairs and Mobility Scooters

Wheelchair and mobility scooter users are advised to notify FGTL during the booking process if they require assistance between their vehicle and the bus loading area.

Customer assistants at Park & Ride Sites are obliged to provide reasonable assistance to all customers on the basis of a helping hand or hands, only at the request of the customer, unless there is a risk to the health and safety of any customer, the assistant or to a member of the public.

Where a requirement exists for assistance beyond the limits outlined above the customer will need to travel with a companion capable of performing these tasks.

Liability for loss or damage

We and our contractors will use our reasonable skill and care in the operation of each Park & Ride Site. However, that responsibility is limited and we are only liable as set out in paragraphs (a), (b) and (c) below and we will have no other liability to you.

  1. We are liable for death or personal injury resulting from the negligence of the ODA, its employees, agents or contractors and nothing in these terms & conditions shall exclude that liability.
  2. We are liable for the loss of or damage to or theft of or from, your vehicle or property arising from our negligence and the negligence or dishonesty of our employees, agents or contractors.
  3. Except as set out in paragraph (a) above, we shall only be liable for losses which were reasonably foreseeable at the time of entering into a contract with you on the basis of these terms & conditions.

You should note that although we have the responsibility to you described above, the Park & Ride Sites are open to everyone. We cannot guarantee that people will not enter Park & Ride Sites and cause damage to vehicles or other property or engage in criminal behaviour. Accordingly, you park your vehicle and leave any possessions in your vehicle at the Park & Ride Sites at your own risk. We do not guarantee the security of your vehicle and/or its contents.

Claims and complaints procedure

If your vehicle is damaged or you lose any of your possessions from your vehicle while at a Park & Ride Site, you should:

  1. immediately inform Park & Ride site staff
  2. in the case of theft, immediately inform the police;
  3. notify your insurers promptly.

If you consider that you have a claim against us you must contact the FGTL call centre on 0844 921 2012 within seventy-two (72) hours of discovery of the loss, damage or theft giving full details. Before contacting the FGTL call centre you should satisfy yourself that the subject matter of your claim lies within the areas of our responsibility set out under the heading "Liability for loss or damage" above.


ANNEX 4

BLUE BADGE HOLDERS

By purchasing parking at a Blue Badge Site (other than a Park & Ride Site), you agree to be bound by the following additional terms & conditions in respect of parking your vehicle at the Blue Badge Site. In addition, where the owner or operator of the Blue Badge Site where you have purchased parking has its own terms and conditions in respect of that site, you will be bound by those terms & conditions.

If you are a Blue Badge holder and have purchased parking at a Park & Ride Site, the terms & conditions in Annex 3 (Conditions of use of Park & Ride Sites) will apply.

In this Annex 4, "we" "us" and "our" refers to the ODA, provided that the ODA may delegate its rights and obligations in this Annex 4 to the owner or operator of the Blue Badge Site where you have purchased parking.

General

By purchasing parking at a Blue Badge Site, you agree that you are entering into a contract with us on the basis of these terms & conditions not only for yourself, but also that you are entering into this contract on behalf of any passengers in your vehicle and the legal owner of the vehicle. This means that we may enforce the terms of this contract against you or any passenger or the legal owner of the vehicle. Equally, you, any passenger and the legal owner of the vehicle can enforce the terms of the contract against us.

We reserve the right, when operating conditions require, to transfer customers' bookings to an alternative Blue Badge Site serving the same Games Venue.

We shall have the right to remove any customer from a Blue Badge Site for the safety of such customer or other customers or site staff, including, but not limited to:

  1. persons whose conduct is disorderly, offensive, abusive, or violent, or is such or likely to be such as to make him or her objectionable to other customers or prospective customer;
  2. persons who fail to comply with the instructions of site staff or interfere with their duties;
  3. persons who wear or have on or about their person concealed or unconcealed deadly or dangerous weapons; and
  4. persons who are or appear to be under the influence of intoxicating liquor or drugs.
We shall not provide any compensation for customers so removed.

Customers, while using a Blue Badge Site, must not:

  1. behave in a manner which may reasonably be expected to cause any persons to be alarmed, upset, offended or annoyed, or which may reasonably be expected to cause a nuisance or inconvenience to any customer, site staff or other third party (including, without limitation, the use of obscene or offensive language or behaving in a manner that is abusive or threatening);
  2. behave in a manner which may reasonably be expected to result in loss, injury or damage to property or persons;
  3. play radios, musical instruments, mobile telephones, MP3s or other audio equipment with the exception of personal listening devices with an earpiece which must not be played at a volume that is likely to cause nuisance;
  4. sell, or offer for sale, any item;
  5. distribute/display printed or similar matter of any description or distribute any article for the purpose of advertising;
  6. deliberately interfere with any equipment on site.

We will not be liable for any loss, damage, or inconvenience arising from the communication of information in good faith by any of their employees (or their agents and subcontractors).

Arrival and Parking

Customers are requested to arrive at Blue Badge Site within the time slot specified when making their booking. Where space is available in the relevant Blue Badge Site, early arrivals will be permitted access to the Blue Badge Site in advance of the time slot specified in the booking. However, if space is not available, customers may only be permitted access to the Blue Badge Site in accordance with the time slot specified in the booking. Late arrivals will be permitted access to the Blue Badge Site until the end of the period specified in their booking.

Customers are required to display the vehicle access permit included in their travel pack (where supplied) in the windscreen of their vehicle prior to arrival at a Blue Badge Site. We reserve the right to refuse entry to Blue Badge Sites to any individual unable to present a valid vehicle access permit.

We also reserve the right to refuse the admission of any vehicle to a Blue Badge Site for any reason whatsoever. Without limitation:

  • where the website indicates that certain types of vehicle are not permitted at a particular Blue Badge Site, vehicles of that type will not be permitted access to that site; and
  • you must not tow any vehicle, caravan or trailer into a Blue Badge Site.

Customers are required to park their vehicle as directed by site staff and in compliance with all signs in the relevant Blue Badge Site. In particular:

  1. where the Blue Badge Site is marked with parking bays, you must park within a marked bay;
  2. you must not park within a bay marked for a specific purpose unless you are entitled to do so.

Where you park your vehicle in breach of the above requirement (or otherwise as may be reasonably required for the safety of persons or property), we may move your vehicle within the Blue Badge Site, by driving or otherwise, using whatever method we consider appropriate (even if damage is caused to your vehicle as a result) to such extent as is reasonably necessary for the purposes of the safety of persons or property or to avoid obstruction.

Blue Badge Site Security

Customers are not permitted to bring any material onto a Blue Badge Site that would be classified as a hazardous material, or which may inconvenience, or present a danger or discomfort to, other customers. Customers are also not permitted to bring any animal (other than guide, or other assistance, dogs) onto a Blue Badge Site.

Blue Badge Site staff must be advised immediately if any suspicious article or package is seen on site.

If you, your vehicle or any of the passengers in your vehicle damage any equipment at the Blue Badge Site then, except where the damage is the result of our negligence, we will have the right to recover from you the repair cost in respect of that damage plus associated administration costs.

No work on or cleaning of vehicles is permitted at any Blue Badge Site. If your vehicle breaks down you must contact the Blue Badge site staff to ensure that the repair or removal of your vehicle is organised without causing disruption, damage or danger to any other person or property in the Blue Badge Site.

If you or any of the passengers in your vehicle damage another vehicle at the Blue Badge Site you should report the matter to Blue Badge Site staff giving the registration numbers of both vehicles. You must also notify the owner of the other vehicle by leaving a note on the windscreen of their vehicle providing your vehicle and contact details and any other details that are relevant to the incident.

Security of your vehicle and possessions

Before you leave your vehicle you should ensure that it is securely locked, all of the windows are securely closed and if your vehicle is fitted with a vehicle alarm, steering lock, or similar device, that it is engaged.

Wherever possible, you should not leave possessions in your vehicle. If you do leave possessions in your vehicle, you do so at your own risk.

No overnight parking

Overnight parking is not permitted at Blue Badge Sites. Any vehicle remaining at a Blue Badge Site after 03:00 will be treated as an abandoned vehicle and may be removed from the site where necessary for operational or security reasons.

If you have provided us with a mobile telephone number and indicated your agreement to our contacting you, site staff will endeavour to contact you before proceeding to remove your vehicle from the site.

At our discretion we may permit vehicles to be left on site overnight in the event of an emergency and where contact has been made with the customer.

Abandoned vehicles removed from Blue Badge Sites will be stored in a secure location and the customer shall be responsible for all storage charges.

We reserve the right to dispose of any abandoned vehicles and will be entitled to treat any vehicle not reclaimed within 28 days as abandoned. Before disposing of any abandoned vehicle, we will make reasonable enquiries with the appropriate Police authority.

Where we intend to dispose of an abandoned vehicle, the relevant vehicle will be sold by auction whenever practicable. The proceeds of sale will be used towards satisfaction of all sums owing to us together with the expenses of sale and reasonable storage charges for the period during which the vehicle is in our possession. If there is any balance remaining from the sale proceeds after satisfaction of these sums, we will hold that balance on behalf of the registered owner of the vehicle and will pay that balance to the registered owner on proof of entitlement.

Wheelchairs and Mobility Scooters

If you use a wheelchair or mobility scooter, you are advised to notify FGTL of this fact during the booking process. The booking staff will be able to advise you of the relevant features of each Blue Badge Site (e.g. the availability of lifts).

If you require assistance between your vehicle and the Games Venue, although we make no general commitment to make such assistance available, the booking staff will advise you of whether any such assistance is available at any of the relevant Blue Badge Sites.

Where you have a requirement for assistance between your vehicle and the Games Venue which we are unable to provide, you will need to travel with a companion capable of performing these tasks.

Liability for loss or damage

Although we have sought to ensure that all Blue Badge Sites are safe and are operated with reasonable skill and care, the ODA is not responsible for the operation of Blue Badge Sites (other than the Park & Ride Sites). As such, although we are liable for death or personal injury resulting from the negligence of the ODA, its employees, agents or contractors and nothing in these terms & conditions shall exclude that liability, we will have no other liability to you. In particular we are not liable for the loss of or damage to or theft of or from, your vehicle or property while at a Blue Badge Site (other than a Park & Ride Site). Accordingly, you park your vehicle and leave any possessions in your vehicle at the Blue Badge Sites at your own risk. We do not guarantee the security of your vehicle and/or its contents.

Claims and complaints procedure

If your vehicle is damaged or you lose any of your possessions from your vehicle while at a Blue Badge Site, you should:

  1. immediately inform Blue Badge Site staff
  2. in the case of theft, immediately inform the police;

ANNEX 5

PRIVATE CHARTER

By purchasing Private Charter services, you agree to be bound by the following additional terms & conditions.

In this Annex 5, "we" "us" and "our" refers to the ODA, provided that the ODA may delegate its rights and obligations in this Annex 5 to any contractor that the ODA may appoint to manage any Transit Mall or the Barking Bus Depot.

General

We reserve the right, when operating conditions require:

  • to transfer customers' bookings for use of one Transit Mall to an alternative Transit Mall;
  • to transfer customers' bookings for parking at the Barking Bus Depot to an alternative site within a reasonable distance of the Olympic Park.

We shall have the right to remove any customer from a Transit Mall or the Barking Bus Depot for the safety of such customer or other customers or site staff, including, but not limited to:

  1. persons whose conduct is disorderly, offensive, abusive, or violent, or is such or likely to be such as to make him or her objectionable to other customers or prospective customer;
  2. persons who fail to comply with the instructions of site staff or interfere with their duties;
  3. persons who wear or have on or about their person concealed or unconcealed deadly or dangerous weapons; and
  4. persons who are or appear to be under the influence of intoxicating liquor or drugs.
We shall not provide any compensation for customers so removed or whose vehicles are refused admission.

Customers, while using a Transit Mall or the Barking Bus Depot, must not:

  1. behave in a manner which may reasonably be expected to cause any persons to be alarmed, upset, offended or annoyed, or which may reasonably be expected to cause a nuisance or inconvenience to any customer, site staff or other third party (including, without limitation, the use of obscene or offensive language or behaving in a manner that is abusive or threatening);
  2. behave in a manner which may reasonably be expected to result in loss, injury or damage to property or persons;
  3. play radios, musical instruments, mobile telephones, MP3s or other audio equipment with the exception of personal listening devices with an earpiece which must not be played at a volume that is likely to cause nuisance;
  4. use roller skates, roller blades, scooters or skateboards;
  5. sell, or offer for sale, any item;
  6. distribute/display printed or similar matter of any description or distribute any article for the purpose of advertising;
  7. deliberately interfere with any equipment on site.

We will not be liable for any loss, damage, or inconvenience arising from the communication of information in good faith by any of our employees (or their agents and subcontractors).

Ambush Marketing

You shall not in connection with any Private Charter:

  1. undertake any form of Ambush Marketing;
  2. represent, directly or indirectly, that you are an official sponsor of the London 2012 Games or any Games Body; or
  3. except as permitted by this agreement, use in advertising, publicity or any other communication, whether written, electronic or any other means any trademark or other intellectual property rights or the name of any Games Body.
LOCOG and after its dissolution an appropriate Games Body may enforce the terms of this paragraph of this Annex 5 in accordance with the Contracts (rights of third parties) Act 1999.

Access to the Transit Malls

Customers are requested to arrive at the relevant Transit Mall within the time slot specified when making their booking. The ODA reserves the right to refuse access to any customer that arrives outside their booked time slot.

Customers are required to display the vehicle access permit included in their travel pack (where supplied) in the windscreen of their vehicle prior to arrival at a Transit Mall. We reserve the right to refuse entry to Transit Malls to any individual unable to present a valid vehicle access permit.

We also reserve the right to refuse the admission of any vehicle to a Transit Mall for any reason whatsoever. Without limitation:

  • where the website indicates that certain types of vehicle are not permitted at a Transit Mall, vehicles of that type will not be permitted access to that site; and
  • you must not tow any vehicle, caravan or trailer into a Transit Mall.

Customers are required to obey instructions given by Transit Mall staff and to park their vehicle in a bay as directed by Transit Mall staff and in compliance with all signs at the relevant Transit Mall. In particular, once you have been directed to a bay by the Transit Mall staff, you must remove your vehicle from that bay within 10 minutes of parking your vehicle in that bay and then depart from the Transit Mall.

Where you park your vehicle in breach of the above requirement (or otherwise as may be reasonably required for the safety of persons or property), we may move your vehicle within the Transit Mall, by driving or otherwise, using whatever method we consider appropriate (even if damage is caused to your vehicle as a result) to such extent as is reasonably necessary for the purposes of the safety of persons or property or to avoid obstruction.

Arrival and Parking at Barking Bus Depot

Customers are requested to arrive at Barking Bus Depot within the time slot specified when making their booking. Where space is available at Barking Bus Depot, early arrivals will be permitted access to the depot in advance of the time slot specified in the booking. However, if space is not available, customers may only be permitted access to the depot in accordance with the time slot specified in the booking. Late arrivals will be permitted access to the depot until the end of the period specified in their booking.

Customers are required to display the vehicle access permit included in their travel pack (where supplied) in the windscreen of their vehicle prior to arrival at Barking Bus Depot. We reserve the right to refuse entry to Barking Bus Depot to any individual unable to present a valid vehicle access permit.

We also reserve the right to refuse the admission of any vehicle to Barking Bus Depot for any reason whatsoever. Without limitation:

  • where the website indicates that certain types of vehicle are not permitted at Barking Bus Depot, vehicles of that type will not be permitted access to that site; and
  • you must not tow any vehicle, caravan or trailer into Barking Bus Depot.

Customers are required to park their vehicle as directed by site staff and in compliance with all signs in Barking Bus Depot. In particular:

  1. where Barking Bus Depot is marked with parking bays, you must park within a marked bay;
  2. you must not park within a bay marked for a specific purpose (e.g. a space for the disabled) unless you are entitled to do so.

Where you park your vehicle in breach of the above requirement (or otherwise as may be reasonably required for the safety of persons or property), we may move your vehicle within Barking Bus Depot, by driving or otherwise, using whatever method we consider appropriate (even if damage is caused to your vehicle as a result) to such extent as is reasonably necessary for the purposes of the safety of persons or property or to avoid obstruction.

Site Security

Customers are not permitted to bring any material onto a Transit Mall or Barking Bus Depot that would be classified as a hazardous material, or which may inconvenience, or present a danger or discomfort to, other customers. However, if you require advice in respect of facilities at a Transit Mall for the users of wheelchairs or mobility scooters you are advised to contact the call centre on 0844 921 2012.

Liability for loss or damage

We and our contractors will use our reasonable skill and care in the operation of the Transit Malls and Barking Bus Depot. However, that responsibility is limited and we are only liable as set out in paragraphs (a), (b) and (c) below and we will have no other liability to you.

  1. We are liable for death or personal injury resulting from the negligence of the ODA, its employees, agents or contractors and nothing in these terms & conditions shall exclude that liability.
  2. We are liable for the loss of or damage to or theft of or from, your vehicle or property arising from our negligence and the negligence or dishonesty of our employees, agents or contractors.
  3. Except as set out in paragraph (a) above, we shall only be liable for losses which were reasonably foreseeable at the time of entering into a contract with you on the basis of these terms & conditions.

ANNEX 6

DEFINITIONS

Ambush Marketing
means any activity, commercial or non-commercial, undertaken by you, that creates, implies or refers to a direct or indirect association of any kind (including an association in the minds of members of the public) with any Games Body or the London 2012 Games (including by reference to the city of London and the year 2012), other than in accordance with this agreement, and the display or distribution of advertising materials or products with the intention of gaining exposure for any brand in or within the vicinity of Games Venues during Games time, which has not been properly authorised under this agreement or by LOCOG or any other Games Body
Blue Badge
means a badge issued under the Blue Badge Scheme which entitles the holder to a range of parking concessions.
Blue Badge Sites
means the locations referred to in this website where parking is available for Blue Badge holders.
Booking Service
means this website and the booking service contained in this website.
Conditions of Carriage
means the conditions of carriage on the coach services and Park & Ride Shuttle services as set out in Annex 2.
FGTL
means First Games Transport Limited, a company registered in England with company registration number 07606109 and whose registered office is at 50 Eastbourne Terrace, Paddington, London W2 6LG.
Games
means the games of the thirtieth Olympiad and the Paralympic Games that are to take place in 2012 in London.
Games Body
means each of the International Olympic Committee, the International Paralympic Committee, the British Olympic Association, the British Paralympic Association and (where the context admits) LOCOG, the Olympic Delivery Authority or any other organising committee of an Olympic and/or Paralympic Games and Games Bodies shall be construed accordingly.
Games Venue
means a venue or any parking area (including any public area) at, in or through or near which a Games event is to be held.
MML
means Mott MacDonald Limited, the service provider contracted by the ODA to manage the Park & Ride Sites.
ODA
means the Olympic Delivery Authority, a statutory corporation whose principal office is at One Churchill Place, London E14 5LN.
Order Confirmation
means the order confirmation to be sent to you by FGTL if your offer to purchase services is accepted.
Park & Ride Shuttle
means a bus or coach providing transport between a Park & Ride Site and a Games Venue and operated by FGTL or another FirstGroup company.
Park & Ride Sites
means the park and ride sites referred to in this website.
Private Charter
means a bus or coach service to or from a Games Venue which has been chartered by an individual or group.
Transit Malls
means the transit malls at the Games Venues referred to in this website.
